The EPA enforces lead paint rules aggressively. Use this 5-point checklist to audit-proof your rentals.

The EPA and HUD actively enforce lead disclosure rules. While the original 1996 cap was $11,000, inflation adjustments have pushed the penalty for a single violation to $21,018 as of 2024. A single lease could have multiple violations (e.g., missing pamphlet, missing signature, missing date), leading to bankrupting fines.

Beyond civil penalties, landlords found to have "knowingly" or "willfully" violated the law can face criminal charges or be held liable for triple damages in civil lawsuits brought by tenants.

Here is your audit-proof checklist:

1. The Pamphlet

You must provide the EPA "Protect Your Family From Lead in Your Home" pamphlet.

  • Digital Delivery: Allowed if the tenant agrees (our platform handles this).
  • Proof: You need a signature acknowledging receipt.

2. The Disclosure Form

This is not just a clause in your lease. It is a specific federal form.

  • Known Hazards: Check "Known" or "No Knowledge".
  • Records: List any reports you have provided.

3. The Records

If you have done renovations or tests, you must attach those reports. Hiding a report is a criminal offense in some jurisdictions.

4. The Signatures

This is where most fail. Three parties must sign:

  1. Lessor (You)
  2. Agent (Property Manager / Realtor)
  3. Lessee (Tenant)

5. The Timing

The disclosure must be signed BEFORE the lease is binding.

  • Correct: Disclosure signed Jan 1, Lease signed Jan 2.
  • Violation: Lease signed Jan 1, Disclosure signed Jan 2.

Our platform automates this entire sequence to ensure the timestamping is perfect every time.
